These Terms of Service & Legal Disclaimer cover two distinct products created by Pasqualino De Marco:

  • WS40 – Weather Station 40 — a WordPress plugin (see Part I);
  • Anna Weather — a WordPress Full Site Editing block theme (see Part II).

The two products are licensed and sold separately. The Part corresponding to the product you download, install, activate, or use applies to that product. Part III (Common Provisions) applies to both. In case of conflict between these Terms and the GNU General Public License with respect to the source code of either product, the GPL prevails.


PART I — WS40 – Weather Station 40

I.1 Acceptance of terms

By downloading, installing, activating, or using WS40 – Weather Station 40 (hereinafter “the Software” or “WS40”), you agree to be bound by these Terms in their entirety. If you do not agree, you must not install or use the Software. These Terms apply to both the free and premium versions of WS40. Nothing in these Terms limits or overrides the rights granted to you by the GPL under which the Software’s source code is distributed; in case of conflict with respect to the source code, the GPL prevails.

I.2 Nature of the software, licensing and intellectual property

WS40 is an original software work created by Pasqualino De Marco and constitutes an opera dell’ingegno (work of authorship) protected under Italian copyright law (Legge 22 aprile 1941 n. 633 and subsequent amendments) and, where applicable, by Directive 2009/24/EC on the legal protection of computer programs and international copyright conventions.

The Software comprises an algorithm — a set of logical and computational instructions — designed to collect, process, store, and display meteorological data within a WordPress environment. As with any software, it may contain defects, errors, or bugs, whether known or unknown at the time of release.

Source code — GPL. The source code of WS40, in both its free and premium versions, is free software released under the GNU General Public License, version 2 or (at your option) any later version (GPL-2.0-or-later). Accordingly, you are free to use, study, modify, and redistribute the source code under the terms of the GPL. The complete text of the license is included in the license.txt file distributed with the Software and is reproduced/linked on this site. These Terms do not restrict, and cannot restrict, any freedom granted to you by the GPL in respect of the code.

Reserved (non-GPL) elements. The following elements are NOT part of the GPL grant and remain the exclusive property of the author, to the extent they are legally separable from the code: the names and trademarks “WS40” and “Weather Station 40”, the logo, the graphical assets and images, and the written documentation and manuals. You may not use the WS40 name, logo, or branding in a manner that misrepresents origin, implies endorsement, or causes confusion, nor redistribute the proprietary graphical assets or documentation outside the freedoms granted by the GPL for the code.

I.3 Commercial license: scope and grant

What you purchase. WS40 Premium is offered through a commercial, perpetual license. Because the code itself is GPL, what you purchase is not a restriction on the code but a perpetual entitlement to: (a) the precompiled Premium distribution, (b) one (1) year of software updates from the date of purchase, and (c) community support, for use on one (1) WordPress installation (one domain or subdomain).

Perpetual nature. The license does not expire. The Software and all Premium features you have unlocked continue to function indefinitely, including after the one-year update period ends. The end of the update period stops only the delivery of new updates and does not deactivate any feature (see I.8).

Your GPL freedoms are unaffected. Nothing above limits the rights the GPL grants you over the source code. The “one site” scope refers to the commercial entitlement (updates and community support tied to your license key), not to a legal cap on your GPL rights in the code.

The free version is distributed on the WordPress.org plugin directory under GPL-2.0-or-later, consistent with the directory’s requirements.

You are asked to observe the following (consistent with the GPL and applicable law):

  • ✓ Keep intact the copyright and license notices contained in the source files, as required by the GPL
  • ✗ Do not use the “WS40” / “Weather Station 40” names, logo, or branding to misrepresent origin, imply endorsement, or create a confusingly similar product or service
  • ✗ Do not redistribute the proprietary graphical assets or documentation outside the freedoms the GPL grants for the code
  • ✗ Do not resell or transfer your license key / update-and-support entitlement to a third party (the GPL code itself may be redistributed under the GPL; the commercial entitlement is personal)
  • ✗ Do not use WS40 in any way that violates applicable law or third-party rights
  • ✗ Do not abuse promotional codes or the support community fraudulently

I.4 Pricing, update period and renewal

WS40 Premium is a one-time purchase of a perpetual license. The price is €19.90 per site, excluding applicable VAT. The purchase includes one (1) year of software updates and access to community support.

Perpetual use. The license does not expire. After the one-year update period ends, the Software and all Premium features you have unlocked remain fully active and functional. The end of the update period does not deactivate any feature — it only stops the delivery of new updates.

Optional renewal. Renewing is optional and only extends the update period for a further year at the then-current standard price (€19.90/year). You are never required to renew in order to keep using the Software. If a renewal subscription is offered through Freemius, you will be notified before any renewal and may cancel at any time before the renewal date; cancelling does not affect your right to continue using the Software you already own.

Launch offer. Promotional discounts (including coupon LAUNCH20) apply only to the initial purchase. Any optional renewal is billed at the standard price unless a new promotion is expressly offered.

Free trial. A 30-day free trial may be available. No charge is made during the trial period. Freemius terms apply to trial activation and conversion.

I.5 Refund policy

Refund requests are handled by Freemius Inc. in accordance with their refund policy. As a general rule, a refund may be requested within 30 days of the purchase if the Software does not function as described and the issue cannot be resolved through community support. Refunds are not available for any optional renewal charge where the renewal was not cancelled before the renewal date. The author may assess refund requests on a case-by-case basis.

I.6 No warranty — software provided “as is”

CONSISTENT WITH THE GPL, WS40 IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. THE AUTHOR MAKES NO WARRANTY THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR FREE OF BUGS, DEFECTS, OR VULNERABILITIES. AS AN ALGORITHMIC SYSTEM, WS40 MAY PRODUCE INCORRECT, INCOMPLETE, OR DELAYED RESULTS DUE TO SOFTWARE ERRORS, HARDWARE FAILURES, NETWORK ISSUES, THIRD-PARTY API CHANGES, OR OTHER CAUSES OUTSIDE THE AUTHOR’S CONTROL.

In particular, the author does not warrant the accuracy, completeness, or reliability of meteorological data processed or displayed by WS40, which depends entirely on the data source (weather station, Meteobridge, Cumulus, Davis WeatherLink API, or other third-party systems) provided by the user.

I.7 Limitation of liability

To the maximum extent permitted by applicable law (and consistent with sections 11–12 of the GPL), the author shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to the use or inability to use WS40, including but not limited to: loss of data, revenue, profits, or business opportunities; damage to your WordPress installation, database, server, or hosting environment; errors or inaccuracies in meteorological data displayed by the plugin; incompatibility with third-party plugins, themes, or hosting environments; service interruptions caused by WordPress updates, PHP version changes, or API deprecations; any decision made by the user based on data displayed by WS40.

In any event, the author’s total cumulative liability shall not exceed the amount paid by the user for the Software in the twelve (12) months preceding the event giving rise to the claim.

I.8 Updates and continuity

Updates are provided during the one-year update period included with each purchase, and during any optional renewal period. When the update period ends, the Software continues to function with all unlocked features active; only the delivery of new updates stops until the license is optionally renewed. Because the code is GPL, you also remain free to obtain, modify, and apply changes to the source code yourself under the terms of the GPL.

The author may modify, update, or discontinue future development of WS40 or any of its features at any time, with or without notice, and does not guarantee that any specific feature will be added or maintained in future versions. Discontinuing future development does not affect your right to use the version of the Software you already own, nor the GPL rights attached to its code.

I.9 User responsibilities

The user is solely responsible for: maintaining regular backups of their WordPress installation and database before installing or updating WS40; ensuring that the use of WS40 complies with all applicable laws in their jurisdiction, including data-protection laws; verifying the accuracy of meteorological data before relying on it for any purpose, including safety-critical applications; maintaining a compatible hosting environment and keeping WordPress and PHP updated.

I.10 Third-party dependencies

WS40 integrates with or depends on third-party systems including WordPress, the Freemius SDK, Davis WeatherLink v2 API, Meteobridge, and Cumulus. The Freemius SDK is distributed under its own license. The author is not responsible for changes, deprecations, outages, or policy modifications by these third parties that may affect the functionality of WS40. It is the user’s responsibility to maintain a compatible hosting environment (PHP ≥ 8.0, WordPress ≥ 6.0).

Il software è fornito nello stato in cui si trova (as is), senza garanzie. WS40 Premium si acquista con un pagamento unico per una licenza commerciale perpetua a €19,90 a sito, IVA esclusa: la licenza non scade e il plugin continua a funzionare con tutte le funzioni attive anche dopo l’anno di aggiornamenti; ciò che acquisti è l’accesso agli aggiornamenti (1 anno) e al supporto della community per 1 sito, non un limite ai diritti GPL sul codice. Il rinnovo è facoltativo ed estende solo il periodo di aggiornamenti. I pagamenti sono gestiti da Freemius Inc. (Merchant of Record). La GPL sul codice già in tuo possesso non è revocabile da queste condizioni.


PART II — Anna Weather

II.1 Acceptance of terms

By downloading, installing, activating, or using Anna Weather (hereinafter “the Theme” or “Anna Weather”), you agree to be bound by these Terms in their entirety. If you do not agree, you must not install or use the Theme. These Terms apply to both any free and the premium versions of Anna Weather. Nothing in these Terms limits or overrides the rights granted to you by the GPL under which the Theme’s code is distributed; in case of conflict with respect to the code, the GPL prevails.

Anna Weather is a product distinct from the WS40 plugin. It works on its own and integrates cleanly with WS40, but is licensed and sold separately.

II.2 Nature of the theme, licensing and intellectual property

Anna Weather is an original software work created by Pasqualino De Marco and constitutes an opera dell’ingegno protected under Italian copyright law (Legge 22 aprile 1941 n. 633 and subsequent amendments) and, where applicable, by Directive 2009/24/EC and international copyright conventions.

Anna Weather is a WordPress Full Site Editing (FSE) block theme: it provides templates, block patterns, style variations, headers, and site-editing assets for personal weather-station websites, and is designed to pair with the WS40 plugin. As with any software, it may contain defects, errors, or bugs, whether known or unknown at the time of release.

Theme package — GPL. Anna Weather is free software released under GPL-2.0-or-later. Consistent with WordPress’s requirements for themes, the entire theme package — including its PHP, HTML templates, theme.json, CSS, JavaScript, and bundled assets — is distributed under the GPL. Accordingly, you are free to use, study, modify, and redistribute the theme under the terms of the GPL. These Terms do not restrict, and cannot restrict, any freedom granted to you by the GPL in respect of the code and bundled assets.

Reserved (non-GPL) elements. The GPL does not grant trademark rights. To the extent legally separable from the GPL-licensed theme package, the following remain the exclusive property of the author: the name and trademark “Anna Weather”, the associated logo, and the marketing materials, screenshots, promotional graphics, and written documentation published outside the theme package. You may not use the “Anna Weather” name or logo in a manner that misrepresents origin, implies endorsement, or causes confusion, nor present a derivative as the official “Anna Weather” product.

II.3 Commercial license: scope and grant

What you purchase. Anna Weather Premium is offered through an annual commercial license. Because the code is GPL, what you purchase is not a restriction on the code but an entitlement, for the license term, to: (a) the Premium distribution of the Theme and (b) software updates, for use on one (1) WordPress installation (one domain or subdomain). Support is not a paid deliverable: it is provided through the shared community on a best-effort basis, available to all users regardless of license status (see Part III).

License term. The commercial license runs for one (1) year from the date of purchase and renews annually unless cancelled (see II.4). During an active license term you receive software updates for one site. All Premium features you have unlocked remain active and functional indefinitely, including after the license term ends — the annual term governs only the delivery of updates, and never deactivates any feature (see II.4 and II.8).

Your GPL freedoms are unaffected. Nothing above limits the rights the GPL grants you over the theme code and bundled assets. The “one site” scope and the annual term refer to the commercial entitlement (software updates tied to your license key), not to a legal cap on your GPL rights in the code.

You are asked to observe the following:

  • ✓ Keep intact the copyright and license notices contained in the theme files, as required by the GPL
  • ✗ Do not use the “Anna Weather” name or logo to misrepresent origin, imply endorsement, or create a confusingly similar product or service
  • ✗ Do not resell or transfer your license key / update entitlement to a third party (the GPL code itself may be redistributed under the GPL; the commercial entitlement is personal)
  • ✗ Do not use Anna Weather in any way that violates applicable law or third-party rights
  • ✗ Do not abuse promotional codes or the community fraudulently

II.4 Pricing, license term and renewal

Anna Weather Premium is an annual license priced at €2.90 per site per year, excluding applicable VAT. The license includes a 7-day free trial and software updates for the duration of the active term, for one (1) site. Support is not sold: it is provided through the shared community, available to all users on a best-effort basis (see Part III).

Free trial. A 7-day free trial is available. No charge is made during the trial period. If the trial is not cancelled before it ends, it converts to a paid annual license and the €2.90/year fee (plus applicable VAT) is charged. Freemius terms apply to trial activation and conversion.

Renewal. The annual license renews automatically at the then-current standard price (€2.90/year) unless cancelled. You will be notified before any renewal and may cancel at any time before the renewal date through Freemius. Cancelling stops future renewals and the delivery of further updates at the end of the paid term; it does not deactivate any feature and does not remove the GPL rights attached to the code you already possess.

Continuity of use — you keep the features. The license does not disable anything. When the annual term ends, Anna Weather and all Premium features you have unlocked remain fully active and functional; the end of the term stops only the delivery of new updates. An active license is required only to receive further updates — the community remains available to everyone regardless of license status. Because the theme code is GPL, you also remain free under the GPL to use, modify, and redistribute the version you already possess.

Promotions. Any promotional discount applies only as expressly stated for the initial purchase; renewals are billed at the standard price unless a new promotion is expressly offered.

II.5 Refund policy

Refund requests are handled by Freemius Inc. in accordance with their refund policy. Because a 7-day free trial is offered before any charge, you are able to evaluate the Theme at no cost before payment. As a general rule, a refund may be requested within 30 days of a charge if the Theme does not function as described and the issue cannot be resolved through community support. Refunds are not available for a renewal charge where the renewal was not cancelled before the renewal date. The author may assess refund requests on a case-by-case basis.

II.6 No warranty — theme provided “as is”

CONSISTENT WITH THE GPL, ANNA WEATHER IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. THE AUTHOR MAKES NO WARRANTY THAT THE THEME WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR FREE OF BUGS, DEFECTS, OR VULNERABILITIES, NOR THAT IT WILL BE COMPATIBLE WITH ANY PARTICULAR PLUGIN, THEME, BLOCK, BROWSER, OR HOSTING ENVIRONMENT.

As a Full Site Editing theme, Anna Weather’s appearance and behavior depend on the WordPress version, the block editor, other active plugins and themes, and user customizations made through the Site Editor. The author does not warrant that any specific visual result, layout, or integration (including integration with the WS40 plugin or any data it displays) will be achieved or maintained across future WordPress or plugin releases.

II.7 Limitation of liability

To the maximum extent permitted by applicable law (and consistent with sections 11–12 of the GPL), the author shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to the use or inability to use Anna Weather, including but not limited to: loss of data, revenue, profits, or business opportunities; damage to your WordPress installation, database, server, or hosting environment; loss of customizations, layouts, or content resulting from theme installation, updates, or switching; incompatibility with third-party plugins, themes, blocks, or hosting environments; service interruptions caused by WordPress updates, PHP version changes, or block/editor changes; any decision made by the user based on content displayed within a site built with the Theme.

In any event, the author’s total cumulative liability shall not exceed the amount paid by the user for the Theme in the twelve (12) months preceding the event giving rise to the claim.

II.8 Updates and continuity

Updates are provided during any active annual license term (including the paid period following a converted trial and any renewal period). When the license lapses, the Theme and all unlocked Premium features continue to function normally; no feature is deactivated. Only the delivery of new updates stops until the license is optionally renewed; the community remains available to everyone. Because the code is GPL, you also remain free to obtain, modify, and apply changes to the code yourself under the terms of the GPL.

The author may modify, update, or discontinue future development of Anna Weather or any of its features, patterns, or style variations at any time, with or without notice, and does not guarantee that any specific feature will be added or maintained in future versions. Discontinuing future development does not affect your right to use the version of the Theme you already own, nor the GPL rights attached to its code.

II.9 User responsibilities

The user is solely responsible for: maintaining regular backups of their WordPress installation and database before installing, updating, or switching to Anna Weather; ensuring that the use of Anna Weather complies with all applicable laws in their jurisdiction, including data-protection and accessibility laws; testing the Theme and its Site Editor customizations before relying on them in production; maintaining a compatible hosting environment and keeping WordPress and PHP updated.

II.10 Third-party dependencies

Anna Weather runs on and depends on third-party systems including WordPress and the Freemius SDK, and is designed to integrate with the WS40 plugin. The Freemius SDK is distributed under its own license. Anna Weather functions as a standalone theme and does not require WS40 to operate; the WS40 integration is optional. The author is not responsible for changes, deprecations, outages, or policy modifications by these third parties that may affect the functionality or appearance of the Theme. It is the user’s responsibility to maintain a compatible hosting environment (PHP ≥ 8.0, WordPress ≥ 6.0, with Full Site Editing support).

PART III — Common Provisions (apply to both WS40 and Anna Weather)

III.1 Payments, VAT and taxes

All payments are processed exclusively by Freemius Inc., which acts as the Merchant of Record. Freemius is responsible for collecting and remitting applicable VAT or sales tax in accordance with the laws of the buyer’s jurisdiction. EU customers will be charged VAT at the rate applicable in their country of residence.

The author (Pasqualino De Marco) operates as a private individual and carries out a non-business activity for VAT purposes (D.P.R. 633/1972). The author does not hold a VAT number (Partita IVA) and does not issue VAT invoices directly. All VAT obligations toward customers are fulfilled by Freemius Inc. as Merchant of Record. For business customers requiring a VAT invoice, please contact Freemius support at freemius.com; the author cannot issue VAT invoices directly.

III.2 Support

Support for both products is provided on a community, best-effort basis through the shared community forum at weatherstation40.live/community and, where possible, via email at info@weatherstation40.live. There is no guaranteed response time, no priority support tier, and no service-level commitment for any user, free or premium. For WS40, community-support access is included with a Premium purchase; for Anna Weather, the community is available to all users regardless of license status. In both cases, support is offered by the community and the author on a voluntary, best-effort basis, and does not cover issues arising from user modifications, incompatible third-party plugins/themes/blocks, or unsupported hosting environments.

III.3 Termination

These Terms govern the commercial relationship and the use of the reserved (non-GPL) elements described in I.2 and II.2. The author may suspend or terminate your commercial entitlement (license key and software updates, and — for WS40 — access to the support community), and may remove access to the community, without refund, in the event of a material breach of these Terms — including misuse of a product’s name, logo, or branding, fraudulent use of promotional codes, or abuse of the community.

For clarity, and consistent with the GPL: the GPL license covering the source code and bundled assets already in your possession is granted by the GPL itself and is not revoked by these Terms. Termination affects only the commercial entitlement (updates, support, license key) and the right to use the reserved trademarks and proprietary materials.

III.4 Modifications to these terms

The author reserves the right to modify these Terms at any time. Changes will be published on this page with an updated date. Continued use of either product after the publication of updated Terms constitutes acceptance of the new Terms. It is the user’s responsibility to review these Terms periodically. Such modifications cannot retroactively alter the GPL license attached to versions of the code already distributed.

III.5 Governing law and jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the Republic of Italy, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms, including any dispute regarding the existence, validity, or termination of these Terms, shall be submitted to the exclusive jurisdiction of the Court of Udine (Tribunale di Udine), Italy.

For consumers residing in the European Union, mandatory consumer protection provisions of the consumer’s country of residence shall apply where required by EU law, including Directive 2011/83/EU on consumer rights and Directive 93/13/EEC on unfair contract terms.
